Terms of Service
Terms of Service
Last Updated: August 19, 2026
1. Overview
This website is operated under the store name FixTimber. Throughout this website, the terms “FixTimber,” “we,” “us,” and “our” refer to the operator of FixTimber.
FixTimber provides this website, including the information, products, features, and customer services available through it, subject to these Terms of Service.
These Terms of Service constitute a legally binding agreement between FixTimber and each person who accesses the website, creates an account, submits information, or purchases a product.
By accessing https://fixtimber.us, placing an order, or otherwise using our website or services, you acknowledge that you have read, understood, and agreed to these Terms of Service and the policies incorporated into them by reference.
If you do not agree to these Terms, you must not use the website or place an order.
2. Incorporated Policies
The following policies form part of these Terms of Service:
- Privacy Policy
- Return & Refund Policy
- Shipping & Delivery Policy
- Any product-specific terms, warnings, or warranty information displayed before purchase
If there is a conflict between these Terms and a product-specific written term, the more specific term will apply to that product. Applicable law will control where a consumer right cannot legally be waived or limited.
3. Eligibility and Age Requirements
You must be at least the age of majority in your state, province, territory, or country of residence to place an order or create an account.
If you permit a minor to browse the website under your supervision, you are responsible for that minor’s use of the website. Minors may not independently purchase products unless permitted by applicable law and supervised by a parent or legal guardian.
By placing an order, you represent that:
- You have legal capacity to enter into a binding agreement.
- The information you provide is accurate and complete.
- You are authorized to use the selected payment method.
- Your purchase and intended use of the product are lawful.
4. Online Store Use
You may use the website only for lawful personal or business purchasing purposes.
You must not use the website or our products to:
- Violate any applicable law, regulation, code, or third-party right
- Commit fraud or submit false information
- Interfere with the security or operation of the website
- Introduce malware, malicious code, or harmful technology
- Collect information about other users without authorization
- Circumvent purchasing limits or technical restrictions
- Place orders for unlawful resale or export
- Impersonate another person or organization
- Use automated systems to scrape, copy, overload, or disrupt the website without permission
We may restrict or suspend access where reasonably necessary to prevent fraud, unlawful activity, security threats, abuse, or material violations of these Terms.
5. Accounts and Account Security
Some website features may require an account.
You are responsible for:
- Providing current and accurate account information
- Maintaining the confidentiality of your login credentials
- Restricting unauthorized access to your account
- Promptly notifying us of suspected unauthorized use
You must not share another person’s account or use credentials without authorization.
We may require reasonable identity, address, or payment verification before processing an order or responding to an account-related request.
Contact us promptly at dovguorveethar@gmail.com if you believe your account has been compromised.
6. Product Information
FixTimber sells timber, wood, and home repair supplies and related products.
We make reasonable efforts to provide accurate product information, including:
- Descriptions
- Dimensions
- Materials
- Specifications
- Compatibility information
- Photographs
- Installation or usage information
- Availability and pricing
However, minor variations may occur because of manufacturing processes, natural material characteristics, lighting, photography, screen settings, model revisions, or supplier updates.
Wood grain, texture, tone, color, and other natural-material characteristics may vary between individual products and may not constitute a defect.
If a specific measurement, finish, load rating, material, certification, or compatibility requirement is essential to your project, you should contact us and independently verify the requirement before ordering or installation.
7. Product Images and Colors
Product images are provided for identification and general reference.
We cannot guarantee that every device or display will reproduce colors, textures, finishes, or proportions exactly. The product description and listed specifications should be reviewed together with the images.
Decorative objects, tools, timber, structures, or accessories shown in lifestyle images may not be included unless expressly identified as part of the product.
8. Product Availability
All products are subject to availability.
Placing a product in a shopping cart, receiving an order acknowledgment, or completing payment authorization does not guarantee availability.
We may limit quantities or cancel an affected item when:
- The product is unavailable.
- Inventory information is incorrect.
- A supplier cannot fulfill the product.
- The product is subject to a recall or safety concern.
- The destination is restricted.
- A pricing or listing error occurred.
- Fraud or unauthorized payment is reasonably suspected.
- Fulfillment would violate applicable law.
If we cancel a paid product or order, we will issue the applicable refund to the original payment method.
9. Orders and Contract Formation
After an order is submitted, we normally send an order confirmation email acknowledging receipt.
The order confirmation is not necessarily final acceptance of the order. A binding sales contract is generally formed when we send a shipping confirmation or otherwise expressly confirm that the order has been accepted for fulfillment.
We reserve the right to accept, decline, limit, or cancel an order for legitimate reasons, including:
- Product unavailability
- Incorrect pricing or product information
- Payment authorization failure
- Suspected fraud or misuse
- Shipping restrictions
- Safety concerns
- Legal or regulatory requirements
- Errors affecting fulfillment
If payment has been collected for an order we do not accept, we will issue the applicable refund.
10. Order Information
You agree to provide current, complete, and accurate information when placing an order, including:
- Full name
- Billing address
- Shipping address
- Email address
- Telephone number
- Payment information
You are responsible for reviewing your order details before submission.
If you discover an error, contact us within 12 hours. We will make reasonable efforts to assist, but changes and cancellations are not guaranteed once processing or fulfillment begins.
11. Prices and Currency
Prices are displayed in the currency shown on the website or during checkout.
Prices may change without notice, but a price change will not ordinarily affect an order already accepted, except where:
- There is an obvious pricing error.
- The customer requests an order modification.
- Applicable taxes, duties, or government charges change.
- Applicable law permits or requires an adjustment.
Discount codes and promotional offers:
- May have separate eligibility requirements
- May expire
- May not be combined unless expressly stated
- Have no cash value
- May be cancelled if obtained or used fraudulently
12. Pricing and Listing Errors
We may correct typographical errors, inaccurate descriptions, incorrect prices, unavailable promotions, shipping calculation errors, or other material listing mistakes.
If an error affects an order, we may:
- Contact you for instructions
- Offer the product under corrected terms
- Cancel the affected product or order
- Issue an applicable refund
We will not charge a higher corrected price without your authorization.
Nothing in this section permits deceptive pricing or limits rights arising under applicable consumer protection law.
13. Taxes, Duties, and Import Charges
Customers are responsible for taxes displayed and collected during checkout.
For international orders, customers may also be responsible for:
- Import duties
- Customs taxes
- Value-added tax
- Brokerage fees
- Clearance costs
- Other government or carrier charges
These amounts are generally not included unless expressly shown during checkout.
Customers are responsible for determining whether a product can lawfully be imported, possessed, installed, or used in their jurisdiction.
14. Payment
Payment must be made using a payment method offered during checkout.
Payment transactions may be processed by independent payment service providers. Their terms and privacy practices may also apply.
You represent that:
- You are authorized to use the payment method.
- Payment information is accurate.
- The transaction does not violate applicable law.
- Sufficient funds or credit are available.
We may delay or cancel processing where payment cannot be authorized or where reasonable fraud-prevention verification is required.
We do not ask customers to send complete payment-card numbers, banking passwords, or other unnecessary sensitive financial credentials by email.
15. Shipping and Delivery
Shipping charges, processing times, estimated delivery times, tracking, split shipments, address issues, delayed packages, and international delivery are governed by our Shipping & Delivery Policy.
The standard shipping fee is:
$6.90 per order
Typical timeframes are:
- Processing: 1–3 business days
- United States delivery: 5–10 business days after processing
- International delivery: 10–20 business days after processing
These times are estimates unless a guaranteed date is expressly stated.
If we cannot ship within an advertised or legally applicable time, we will provide any delay notice, cancellation option, or refund required by applicable law.
16. Returns, Refunds, and Exchanges
Returns, refunds, and exchanges are governed by our Return & Refund Policy.
Unless an exception applies, eligible products may be returned within 30 days after delivery.
Products generally must be unused, uninstalled, unmodified, and returned with their original packaging and included components.
Installed, cut, drilled, painted, stained, assembled, mixed, applied, or otherwise altered products may be ineligible for a change-of-mind return.
Customers must obtain written return authorization and the correct return address before sending a product.
The business address listed on our website is not automatically a return address.
Nothing in our Return & Refund Policy limits non-waivable rights under applicable law.
17. Order Cancellations
Cancellation requests should be submitted within 12 hours after purchase.
Cancellation is not guaranteed because processing may begin shortly after an order is placed.
If an order has already entered fulfillment or shipment, the customer may need to receive the order and follow the Return & Refund Policy.
This restriction does not apply where applicable law independently requires cancellation or a refund, including certain unshipped or materially delayed orders.
18. Timber and Natural-Material Characteristics
Some products may be made from or intended for use with timber, wood, composites, or other natural or manufactured building materials.
Natural wood and timber may vary in:
- Grain
- Texture
- Color
- Moisture content
- Density
- Knots
- Surface appearance
- Dimensional tolerance
Environmental conditions, storage, humidity, temperature, installation methods, coatings, and maintenance can affect product performance.
Customers must determine whether a product is suitable for the particular timber type, environmental condition, substrate, load, application, and project requirements.
19. Installation and Safety
Home repair and construction activities may involve risks including cuts, punctures, falls, chemical exposure, electrical hazards, structural failure, dust inhalation, or property damage.
Before using a product, you must:
- Read the product description and specifications.
- Follow all manufacturer instructions and warnings.
- Use appropriate personal protective equipment.
- Inspect the product before installation or use.
- Confirm compatibility with the intended material and application.
- Follow applicable building codes, permits, and safety requirements.
- Keep hazardous tools and materials away from children.
- Discontinue use if a product appears damaged or unsafe.
Products must not be used for an application that exceeds their stated specifications or safety ratings.
20. Professional Advice Disclaimer
Website content, product descriptions, customer support responses, guides, articles, diagrams, and compatibility suggestions are provided for general informational purposes.
They do not constitute structural engineering, architectural, electrical, plumbing, roofing, legal, code-compliance, or other licensed professional advice.
For structural, load-bearing, electrical, plumbing, roofing, foundation, fire-safety, or other safety-critical work, consult an appropriately qualified and licensed professional.
Customers remain responsible for confirming:
- Product suitability
- Measurements
- Load requirements
- Installation methods
- Permit requirements
- Local building codes
- Environmental and safety conditions
Nothing in this section excludes liability that cannot legally be excluded.
21. Manufacturer Instructions and Warranties
Products may include instructions, warnings, or warranties supplied by their manufacturer.
Where a manufacturer’s warranty applies:
- The warranty terms provided with or linked to the product will govern that warranty.
- Customers should retain proof of purchase.
- Warranty duration and coverage may vary.
- Some claims may require direct communication with the manufacturer.
FixTimber does not create an additional written warranty merely by reselling a product unless we expressly provide one in writing.
However, nothing in these Terms excludes implied warranties, statutory guarantees, or other consumer rights that cannot legally be disclaimed or limited.
Any written warranty required to be available before purchase should be reviewed on the product page or by contacting us before ordering.
22. Recalls and Safety Notices
Products must not be used if they are subject to an applicable recall, stop-use instruction, or confirmed safety notice.
If we become aware of a relevant product recall or material safety concern, we may:
- Suspend or remove the product listing
- Stop or cancel fulfillment
- Contact affected customers when reasonably possible
- Provide instructions from the manufacturer or relevant authority
- Offer a remedy required by applicable law or the applicable recall program
Customers should follow all recall and safety instructions promptly.
You may report a product safety concern to dovguorveethar@gmail.com. Please include the order number, product information, photographs, and a detailed explanation.
23. Website Information
We make reasonable efforts to keep website information accurate and current.
However, the website may occasionally contain:
- Typographical errors
- Outdated availability information
- Minor specification discrepancies
- Technical errors
- Incomplete content
- Supplier-provided information requiring correction
We may correct errors and update information when reasonably necessary.
This section does not excuse deceptive statements, material misrepresentations, or obligations imposed by applicable law.
Historical or educational content may be provided for reference and should not be treated as current professional advice.
24. Customer Communications
By submitting an order, you agree that we may send transactional communications reasonably necessary to:
- Confirm the order
- Process payment
- Provide tracking
- Communicate delays
- Address safety or recall issues
- Respond to customer service requests
- Provide legally required notices
Transactional communications are separate from promotional marketing.
Marketing communications will be handled in accordance with applicable law and our Privacy Policy. Where an unsubscribe option is legally required, customers may use that option to stop future marketing messages.
25. Reviews, Feedback, and User Content
If you submit a review, photograph, comment, suggestion, or other content, you represent that:
- You have the right to submit it.
- It reflects your honest experience or opinion.
- It does not infringe another person’s rights.
- It is not unlawful, defamatory, fraudulent, threatening, obscene, or malicious.
- It does not contain malware or deceptive links.
- Any material connection, incentive, discount, or compensation is clearly disclosed when required.
You retain ownership of your original content.
By submitting content for publication, you grant FixTimber a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, and use that content in connection with the website and our lawful marketing, subject to applicable privacy and consumer protection laws.
We may moderate or remove content that violates these Terms, but we are not obligated to publish every submission.
We will not require customers to provide only positive reviews or prohibit honest reviews protected by applicable law.
26. Intellectual Property
Unless otherwise stated, the website and its original content—including text, graphics, logos, layouts, design elements, and compilations—are owned by or licensed to FixTimber and protected by applicable intellectual property laws.
You may use the website for personal, non-commercial shopping purposes.
You must not, without permission:
- Copy or republish substantial website content
- Use FixTimber branding in a misleading manner
- Create unauthorized derivative works
- Remove ownership notices
- Imply sponsorship, endorsement, or affiliation
- Use website content for unlawful commercial exploitation
Product names, logos, and trademarks belonging to manufacturers or other third parties remain the property of their respective owners. Their appearance does not imply sponsorship or endorsement unless expressly stated.
27. Third-Party Services and Links
The website may include third-party services or links, including payment providers, shipping carriers, manufacturers, analytics providers, and external websites.
Third parties operate independently and may have their own terms and privacy policies.
We do not control every third-party website and are not responsible for unrelated content, policies, or conduct outside our reasonable control.
The inclusion of a link does not necessarily constitute endorsement.
This section does not exclude responsibility arising from our own selection, representations, or conduct where such responsibility cannot legally be excluded.
28. Privacy and Data Protection
Our collection, use, disclosure, and retention of personal information are described in our Privacy Policy.
By using the website, you acknowledge that electronic communications and data processing may involve third-party service providers and cross-border processing, as described in the Privacy Policy.
If these Terms and the Privacy Policy conflict regarding personal information, the Privacy Policy will generally control for privacy-related matters, subject to applicable law.
29. Prohibited Conduct
You must not:
- Use the website for unlawful or fraudulent purposes
- Submit false orders or payment disputes
- Attempt unauthorized access to systems or data
- Upload malicious software
- Interfere with website security or availability
- Scrape or harvest personal information
- Violate intellectual property or privacy rights
- Misrepresent your identity
- Resell restricted products unlawfully
- Evade export, import, sanctions, or safety restrictions
- Use a product in a manner known to be unlawful or contrary to stated safety instructions
We may cooperate with payment providers, carriers, rights holders, safety authorities, regulators, or law enforcement when reasonably necessary and legally permitted.
30. Suspension and Termination
We may suspend or terminate website access or cancel pending orders where reasonably necessary because of:
- Material violation of these Terms
- Fraud or unauthorized payment
- Security threats
- Unlawful conduct
- Abusive activity
- Product or destination restrictions
- Safety concerns
- Legal or regulatory requirements
Termination does not affect rights or obligations that arose before termination.
If we cancel a paid, unshipped order, we will issue the applicable refund unless the funds are lawfully withheld or restricted.
31. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the website and its general informational content are provided on an “as available” basis.
We do not guarantee that:
- Website access will always be uninterrupted or error-free.
- Every technical defect will be corrected immediately.
- General website content will be suitable for every individual project.
- Every product will be compatible with an application not expressly confirmed in writing.
These limitations do not:
- Exclude express product promises made before purchase
- Override applicable manufacturer warranties
- Exclude implied warranties that cannot legally be disclaimed
- Limit remedies for defective, unsafe, or misdescribed products where prohibited
- Exclude liability for fraud, willful misconduct, or other liability that cannot legally be limited
Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
32. Limitation of Liability
To the maximum extent permitted by applicable law, FixTimber will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses that were not reasonably foreseeable and that arise from:
- Improper product use
- Installation contrary to instructions
- Unauthorized modification
- Failure to verify compatibility or measurements
- Reliance on general information as professional advice
- Use exceeding a stated product rating
- Third-party conduct outside our reasonable control
Where liability may lawfully be limited, FixTimber’s total aggregate liability arising from a particular product or order will not exceed the amount paid to FixTimber for the product or order giving rise to the claim.
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence where exclusion is prohibited
- Fraud or fraudulent misrepresentation
- Willful or reckless misconduct
- Breach of a non-waivable statutory guarantee
- Any other liability that applicable law does not permit us to exclude or limit
Because some jurisdictions do not permit certain liability limitations, some limitations may not apply to you.
33. Indemnification
To the extent permitted by applicable law, you agree to indemnify FixTimber against third-party claims, damages, or reasonable expenses arising directly from:
- Your unlawful use of the website
- Your material violation of these Terms
- Your infringement of another person’s rights
- Your fraudulent conduct
- Your intentional misuse or unauthorized commercial resale of a product
This obligation does not apply to the extent a claim results from FixTimber’s own negligence, breach, unlawful conduct, defective product responsibility, or another matter for which liability cannot legally be transferred.
34. Events Beyond Reasonable Control
We are not responsible for delay or failure caused by events beyond our reasonable control, including:
- Natural disasters
- Severe weather
- Transportation disruptions
- Carrier interruptions
- Customs actions
- Government restrictions
- Labor disputes
- Public emergencies
- Cyberattacks not caused by a failure to use legally required safeguards
- Supply-chain interruptions
We will make reasonable efforts to reduce the effects of such events and provide any notice, cancellation option, or refund required by applicable law.
35. Governing Law and Jurisdiction
These Terms and any dispute arising from them will be governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles.
Subject to any mandatory consumer rights or jurisdictional protections, the courts of the Hong Kong Special Administrative Region will have jurisdiction over disputes relating to these Terms.
If the law of your place of residence gives you a mandatory right to bring a claim in another competent court or applies mandatory consumer protections, this section does not remove those rights.
36. Informal Dispute Resolution
Before commencing formal legal proceedings, you and FixTimber are encouraged to attempt to resolve the matter by contacting customer support.
Please email:
Include:
- Your name
- Order number, if applicable
- A description of the issue
- The resolution requested
- Relevant supporting documents
This informal process does not prevent either party from seeking urgent relief, meeting a legal deadline, reporting a safety issue, or exercising a right that cannot be restricted.
These Terms do not require mandatory arbitration and do not contain a class-action waiver.
37. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary.
The remaining provisions will continue in effect.
38. No Waiver
A failure or delay in enforcing a provision does not waive the right to enforce that provision later.
Any waiver must be clear and apply only to the specific circumstances for which it was given.
39. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign these Terms in connection with a legitimate merger, acquisition, restructuring, sale of business assets, or transfer of website operations, provided that the assignment does not unlawfully reduce existing consumer rights.
40. Entire Agreement
These Terms and the policies incorporated by reference constitute the entire agreement between you and FixTimber concerning use of the website and purchases made through it.
They replace prior discussions or communications concerning the same subject, except for an express written product warranty, order confirmation, or other binding term that specifically applies to a transaction.
Ambiguities will not be interpreted against a party solely because that party drafted the wording.
41. Changes to These Terms
We may update these Terms to reflect changes in:
- Our operations
- Website functionality
- Product offerings
- Applicable law
- Security practices
- Payment or fulfillment arrangements
The updated version will be posted with a revised “Last Updated” date.
Changes generally apply prospectively. Material changes will not retroactively reduce rights relating to an order already placed unless the change is required by law or the customer expressly agrees.
Continued use of the website after an updated version becomes effective constitutes acceptance of the updated Terms for future use, to the extent permitted by law.
